HailMe is a mobile application that helps users create alert presets tied to a map location, choose recipients, and send alerts when a configured location event happens. Features may vary by platform, device, permissions, and network availability.
You may use HailMe only if you are legally allowed to enter into these terms in your jurisdiction. You are responsible for the accuracy of the information you provide, for keeping access to your device secure, and for activity that happens through your account or verified phone number.
To protect users and the integrity of the service, we may immediately suspend, restrict, or limit access to an account where we reasonably suspect: (a) fraud, identity misuse, or unauthorized access; (b) abuse, harassment, or harmful conduct toward other users or recipients; (c) a payment chargeback, dispute, or unresolved billing issue; (d) violation of these Terms or applicable law; or (e) compliance with a court order, regulator request, or other binding legal obligation. Where reasonable, we will notify you of the suspension and give you a chance to respond. Suspension is preventive and does not end the contract by itself; termination follows the process described in section 9.
If you add contacts, recipients, phone numbers, email addresses, message text, or location-based alert presets, you represent that you have the right to use that information and to ask HailMe to deliver messages or alerts related to it.
If a recipient is not reachable through in-app push delivery, HailMe may use SMS delivery where supported. SMS to recipients who are themselves HailMe users is always free; SMS to non-users counts against your plan's monthly SMS quota or, if that is exhausted, against any SMS pack credits on your account (see section 7d). When we send an SMS, your message may include your phone number, the message text, and a map or location link needed for the feature to work.
You must not use HailMe to monitor, harass, spam, stalk, or otherwise misuse another person's data or location.
In addition to the rules in section 5, you must not, and must not allow anyone else to:
HailMe depends on third-party services for some functionality, including mapping and search services, push notification providers, SMS delivery providers, hosting infrastructure, and mobile platform services. Those providers operate under their own terms and privacy practices, and some parts of HailMe will not work without them.
To run HailMe we currently rely on the following sub-processors: Mapbox (maps and search), Twilio (SMS delivery), Firebase Cloud Messaging (push delivery on Android), Apple Push Notification Service (push delivery on iOS), Apple App Store and Google Play (subscription and SMS-pack billing on iOS and Android respectively), Render (application hosting and managed databases), and SendGrid (transactional email). The current list and the country in which each provider processes data is published with the Privacy Policy. We may add, change, or replace sub-processors as the service evolves; where the change is material we will give prior notice through an in-app message or email so you can review it before it takes effect.
We may update, improve, suspend, or remove parts of HailMe at any time. We do not guarantee uninterrupted availability, message delivery timing, map accuracy, or compatibility with every device, operating system, or network. While the service is undergoing pre-release testing, we may suspend, modify, or interrupt features without prior notice in order to investigate defects or improve quality.
HailMe is offered as three plan tiers:
Paid subscriptions are billed monthly or annually, at your choice, through your mobile platform's store: Apple App Store on iOS and Google Play on Android. Apple and Google process the payment — we never see your card or wallet details — and the price you are shown in-app may differ from any headline figure based on local currency, taxes, and store fees. Subscriptions auto-renew at the end of each billing period unless you cancel through the same store before the period ends. Cancellation takes effect at the end of the current period: until then you keep the paid features.
We may introduce new plans, modify the features or limits of existing plans, change pricing, or discontinue a plan tier. For material changes that affect an active paid subscription we will give at least thirty (30) days' prior notice through an in-app message and, where we have your address, by email; the change takes effect at the start of the next renewal period unless you cancel before that date. Continued use of the paid plan after the change takes effect is acceptance of the new terms. Promotional pricing, free trials, and beta-period discounts may be limited in time and are not guaranteed to renew at the same rate.
The Family plan owner is the only person billed by the store. The owner can invite up to four (4) additional members, sharing the Family entitlement across up to five (5) HailMe accounts in total. Members keep their own accounts, contacts, and presets — only the plan benefits are shared.
While in the family, members receive Plus-equivalent features and consume from the family's pooled 120-message monthly SMS quota. The owner may remove any member at any time; a removed member returns to whatever plan they had before joining (Free if they had none). If the owner cancels or is removed under section 9, the family is dissolved at the end of the current billing period and all members return to their previous plan.
Your subscription is tied to your HailMe account, not to a specific device. If you sign in on a device whose store differs from the one where you originally bought the subscription (for example, an iOS device when the subscription was bought on Android), you keep the entitlement on the new device, but cancellation, plan changes, refunds, and billing details remain in the originating store. The app surfaces a "Managed by App Store" or "Managed by Google Play" notice on those devices and links you to the matching store's web subscription manager.
SMS packs are one-time, non-subscription purchases that top up your account's SMS-to-non-user balance. Pack credits do not expire and are not consumed by SMS sent to other HailMe users (those are always free). Pack credits are tied to the purchasing account, are not transferable, and once added to your balance are not refundable except where the store's refund policy or applicable consumer law requires otherwise. For Family plans, pack credits bought by any member top up the family's shared SMS balance.
Refunds for subscriptions and SMS packs are handled by Apple App Store or Google Play according to their published refund policies — we do not issue refunds directly because we never receive the funds. To request a refund, open the order in your store and choose the refund option; we will help where we can with billing questions, but the final decision is the store's. This does not limit any non-waivable refund right you may have under your local consumer-protection law.
SMS delivery to non-HailMe recipients depends on third-party carriers and may fail in some regions or for some numbers. When a failure happens before the message leaves our system the credit is returned to your monthly quota or pack balance; once the message has been handed to the carrier the credit is consumed regardless of downstream delivery, because that part of the cost is irrecoverable on our side.
HailMe and its software, branding, and service materials remain our property or the property of our licensors. You keep ownership of the information and content you submit, but you grant us the limited rights needed to host, process, transmit, and display that content solely to operate the service for you.
We may suspend or stop access to HailMe if you violate these terms, misuse the service, or create risk for other users or the platform. You may stop using the app at any time and may request account deletion as described in the Privacy Policy.
When you request account deletion, we complete the deletion of your account record, contacts, alert presets, and message history within thirty (30) days, except where applicable law requires us to keep specific records for longer (for example, tax or accounting records tied to a paid subscription). Anonymous and aggregated analytics that no longer identify you may persist for service-quality reporting. Encrypted technical backups containing residual data expire on a rolling schedule and are fully purged within ninety (90) days. Once deletion is complete the account cannot be recovered.
HailMe is provided on an "as is" and "as available" basis. It is not an emergency service and must not be relied on for emergency dispatch, personal safety monitoring, medical response, or guaranteed real-time location tracking.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or loss caused by delayed or failed delivery, unavailable providers, inaccurate location data, or misuse by other users. If liability cannot be excluded, our total liability will be limited to the amount you paid us for the service during the 12 months before the event giving rise to the claim, or zero if you used only free features.
Where mandatory consumer law in your country of residence sets a higher minimum floor for compensation, that higher minimum applies. Nothing in these Terms limits or excludes liability for gross negligence, willful misconduct, fraud, or for death or personal injury caused by us, where such limitation or exclusion is forbidden by applicable law. Nothing in these Terms limits rights that cannot be waived under applicable consumer-protection law.
We may update these terms from time to time. When we do, we will update the date at the top of this page. If the changes are material we will also notify you in-app or by email and ask you to confirm the new version before continuing to use paid features. If you continue using HailMe after the updated terms become effective, you agree to the revised version.
You agree to defend, indemnify, and hold us harmless from any third-party claim, demand, regulator action, or loss (including reasonable legal fees) that arises out of or relates to: (a) the content you submit through the service, including recipient lists, message text, and location data; (b) your violation of these Terms or of applicable law; (c) your misuse of the service to infringe a third-party right, such as privacy, image, defamation, harassment, or intellectual-property claims raised by a recipient or any other person. We will let you know promptly about any covered claim and will not settle it in a way that admits liability on your behalf without consulting you first. This section does not apply where the law limits or excludes such indemnities for consumers.
These Terms are governed by the laws of the Republic of Uruguay, without regard to conflict-of-law rules. Any dispute that cannot be resolved through the contact channel will be brought before the ordinary courts of the city of Montevideo, Uruguay. This does not deprive you of the protection of mandatory consumer-protection law in the country where you reside, and where that law gives you the right to bring proceedings in your local courts, that right is preserved.
Severability. If any provision of these Terms is held to be invalid or unenforceable in a given jurisdiction, the remaining provisions remain in full force, and the invalid provision will be interpreted, to the maximum extent allowed by law, in the way closest to its original intent.
Entire agreement. These Terms, together with the Privacy Policy and any plan-specific terms shown in-app at the time of purchase, form the entire agreement between you and us about HailMe and replace any prior agreement on the same subject. Plan-specific terms shown in-app prevail over these Terms only to the extent of a direct conflict, and only for the affected plan.
Force majeure. We are not responsible for delay or failure to perform caused by events beyond our reasonable control, including network outages, provider failures, natural events, war, civil unrest, governmental action, labour disputes, or pandemic-related disruption.
